GENERAL PROVISIONS

Article 1. Purpose of the law and subject of regulation

1. This law regulates the fundamentals of public administration in the sphere of trade, public catering and household services (hereinafter - trade and services) on the territory of the Republic of Armenia, the powers of state administration and local self-government bodies in this sphere and is aimed at regulating activities carried out in the sphere of trade and services, as well as ensuring the protection of consumer rights:

Trade and services activities carried out on the territory of the Republic of Armenia are regulated by this Law, the Civil Code of the Republic of Armenia, other laws of the Republic of Armenia, and in cases stipulated by law - also other legal acts, as well as international treaties of the Republic of Armenia:




Chapter 2.

Trading

Article 2. Basic concepts

The basic concepts of trade within the meaning of this law are՝

seller-a legal entity or individual entrepreneur who sells goods to consumers under a contract of sale;

employee-an individual who directly carries out the sale, working under an employment contract concluded with the seller for remuneration;

the object of trade is a property complex (land plot, building, structure) used for the purchase and sale of goods;

the consumer goods market is a place of trade where food and non-food products are traded;

non-food products-products intended for sale in order to meet the material and cultural and household requirements of the population;

industrial and technical goods-goods intended for use by economic entities, mainly represented in the form of technological equipment, machinery, fuel and raw materials;

agricultural products market is a place of trade where animal products, plants, plant products (hereinafter referred to as agricultural products) and food products are traded;

animal market-a place of trade where live animals are traded;

points of mobile trade-car seats, motorcycle seats, car dealerships, tankers, provided with appropriate equipment for storage and retail of goods;

point of retail sale of liquid fuel, technical liquids, liquefied gas and compressed natural gas-meters of liquid fuel, technical liquids, compressed natural gas, casings, refueling pistols, containers installed for liquid fuel, technical liquids, scales calibrated in accordance with the procedure established by law, Scales and other appropriate permissible measurement measures;

the organizer of the place of trade is a legal entity or an individual entrepreneur who organizes the work of the place of trade, having obligations or rights established by this law;

a shopping center is a set of trade objects owned and managed by the organizer of the place of trade as a whole, where there are also parts allocated for catering, entertainment, and household services;

exhibition and sale is an event organized by a legal entity and (or) an individual entrepreneur for the purpose of concluding purchase and sale agreements and forming regional, interregional and interstate economic relations on their property or leased territory or in a place established by the competent authority;

fair (vernissage) is a market event organized in a designated place on Saturday, Sunday and public holidays established by law, where the purchase and sale is carried out by legal entities and individuals:

Article 3. Types of objects of trade and places of trade

1. The types of retail facilities include shops, kiosks, pavilions, mobile retail outlets and retail outlets for liquid fuel, liquefied gas, compressed natural gas and technical liquids:

2. The types of places of trade include shopping malls, consumer goods markets, agricultural markets, animal markets, fairs (vernissages) and places of exhibition and sale:

Article 4. Requirements for objects of trade

1. Only legal entities and individual entrepreneurs carry out purchase and sale in retail facilities:

2. The sale of food and non-food products, as well as agricultural products at retail facilities should be carried out by commodity groups in separate sections:

Based on the characteristics of this commercial object, the object of trade must be provided, in accordance with the legislation for goods permitted for sale by this Law, with equipment providing conditions for reception, storage and sale, and trade and technological accessories, including scales calibrated in accordance with the procedure established by law, scales and other permissible measurement measures, necessary for the preparation of warehouse, administrative and household goods:

4. Objects of trade must be provided with a sign that meets the requirements established by the Government of the Republic of Armenia:

5. Storefronts and entrances of retail facilities selling these goods must be shrouded in a curtain or tinted glass so that samples of the goods sold are not visible from the outside:

Article 5. Requirements for places of trade

1. In the places of trade, purchase and sale are carried out by legal entities and individual entrepreneurs, with the exception of the cases provided for in part 2 of this article:

2. Individuals who are not individual entrepreneurs are allowed to purchase and sell only at agricultural markets, animal markets and fairs (vernissages):

Individuals who are not individual entrepreneurs are prohibited from selling the goods specified in subparagraphs,, a "and,, b" of part 14 of Article 9 of this law, as well as food products subject to mandatory conformity assessment:

3. The sale of food and non-food products, as well as agricultural products in places of trade should be carried out in isolated isolated parts by commodity groups:

4. Shopping centers, markets for consumer goods, agricultural products and animals should be provided՝

a) hand carts and tracks that ensure their movement to the parking lot;

b) with a parking lot operating within the land plot allocated to them;

c) household amenities and sanitary facilities:

5. The sale of non-food products (with the exception of packaging and prepackaged goods necessary for sale) is prohibited in the markets of agricultural products:

The sale of live animals is prohibited in agricultural markets:

6. The requirements of Part 5 of this Article do not apply to the activities of trading facilities operating on the territory of agricultural products markets:

It is prohibited to sell the goods specified in part 12 of Article 9 of this Law in these objects of trade:

7. The sale of agricultural products is prohibited in consumer goods markets:

8. The requirements of Part 7 of this Article do not apply to the activities of retail facilities operating on the territory of consumer goods markets:

9. The place of trade must be provided with a sign that meets the requirements established by the Government of the Republic of Armenia:

Article 6. Requirements for the seller

1. The Seller is obliged to provide՝

a) compliance with the requirements of the provisions provided for in parts 2, 3, 4, 5 of Article 4 of this law, as well as part 6 of Article 5;

b) each employee with a nomenclature certified by his signature and seal with a photo of the employee, indicating the name, surname and position:

The seller, who is an individual entrepreneur, is obliged to carry a personal card with his photo, indicating the name, surname and number of the certificate of an individual entrepreneur:

The procedure for carrying a personal card is approved by the authorized body of state administration;

c) when making monetary settlements with the consumer (buyer) by means of cash registers, the provision of a cash receipt to the consumer (buyer) with the goods sold, and when carried out without cash registers, the issuance of a document confirming payment of the price of the goods, approved by the Seller, a document;

d) checking the quality of the offered goods by external signs before putting the goods up for sale;

e) wearing work clothes of employees of a commercial facility engaged in the sale of food:

2. When carrying out the purchase and sale (wholesale trade) of goods under the delivery contract, the seller (supplier) is obliged to provide the buyer (customer) with the goods he missed՝

a) a settlement document completed in accordance with the procedure established by law;

b) certificates of conformity of the goods sold in the cases prescribed by law:

3. If the seller (supplier) commits the purchase and sale (wholesale trade) of goods under the supply contract at the trade facilities and at this place of trade, the relevant information must be posted on the signboard about this:
